SCOPE OF APPLICATION
These General Terms and Conditions apply to all orders placed by consumers within the meaning of § 13 BGB (German Civil Code) via the website www.kangaroos.de. The operator of this website and therefore your contractual partner is Bernd Hummel GmbH, Neuffer am Park, 66953 Pirmasens, Germany.
CONFIRMATION
As soon as we have received your order, we will send you an order confirmation to your e-mail address to confirm your purchase. The confirmation of the order does not constitute an acceptance of the contract. The purchase contract is only concluded by our express declaration or the shipment of the goods. It is important that you provide a correct e-mail address when placing your order. We recommend that you save this e-mail to make it easier to contact our customer service in the future. The order confirmation also serves as proof of purchase (receipt).
PAYMENT
Payments can be made with PayPal via credit card or instant bank transfer.
PAYPAL
PayPal offers various payment options and insures orders up to 500 EUR - for this you only need a free account.
If you want to pay your order via PayPal, you will be redirected and asked to log in with your account or to register again. Once this is done, you only need to select the desired payment method (PayPal credit, direct debit or credit card) and confirm the payment. We will receive a confirmation from PayPal and ship your order immediately.
CREDIT CARD
We accept the following types of cards for payment: VISA, Master Card, American Express.
Your payment is processed with secure encryption and in compliance with strict banking standards. Your card details will be sent directly to your bank. Only your bank will have access to these details and will be able to read them. Bernd Hummel GmbH does not charge any additional fees for card payments. However, depending on the card and bank, the bank in question may charge a surcharge. When paying by credit or debit card, initial conditions apply as soon as the card transaction has been approved. If no payment is received after submitting your order, Bernd Hummel GmbH may automatically cancel your order.
DIRECTebanking:
If you choose the payment method DIRECTebanking in the order process, you will be directed to the secure payment form of Sofort GmbH, Theresienhöhe 12, 80339 Munich, Germany. Sofort GmbH automatically takes over the payment process without Bernd Hummel GmbH having any insight. In the case of an instant transfer, Sofort GmbH checks the availability of your account and makes a transfer to us if there is sufficient funds in your account.
To perform an instant bank transfer, the following information is required: Name, bank code, account number and the access data of your online banking. Only your name, bank code, account number, reason for transfer, amount and date of the transfer will be stored, but not the credit limit or account balance of your account or past transactions.
In case of a successful transaction, Bernd Hummel GmbH only receives the automated confirmation in real time from Sofort GmbH that the transfer has been executed.
PRICES
All prices on the website www.kangaroos.de are inclusive of 19% VAT shipping costs are extra. Please note that in case of shipping to a delivery address outside the EU import duties the 19% of VAT will be omitted (automatically at checkout) and instead taxes may apply which will be payable when the shipment reaches your delivery address. You are responsible for paying these import duties and taxes. Please note that we have no control over these costs and, as these costs vary from country to country, the amount of these costs cannot be predicted. We recommend contacting your local customs office for more information.
TERMS OFWITHDRAWAL
- Right of Withdrawal -
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has taken possession of the goods or, in the case of partial deliveries, the last delivery. To exercise your right of withdrawal, you must contact Bernd Hummel GmbH, Neuffer am Park, 66953 Pirmasens, Phone: +49 (0)6331 7107-99, Fax: +49 (0)6331 7107-20, E-Mail: [email protected] by means of a clear declaration (e.g. a letter sent by mail, fax or e-mail) about your decision to revoke this contract. You can use the attached sample cancellation form for this purpose. However, this is not mandatory. If you make use of this option, we will immediately send you (e.g. by email) a confirmation of receipt of your revocation. To meet the cancellation deadline, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.
The right of withdrawal expires with the use of the goods.
CONSEQUENCESOF CANCELLATION
If you cancel this contract, we will reimburse you for all payments we have received from you, including delivery costs (with the exception of additional costs resulting from the fact that you have chosen a type of delivery other than the most favorable standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we received the notification of your cancellation of this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you. In no case will you be charged for this repayment. We can refuse the repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier. You must return or hand over the goods to us without undue delay and in any case no later than within fourteen days from the day on which you notify us of the cancellation of this contract. The deadline is met if you send the goods before the expiry of the period of fourteen days. We will bear the cost of returning the goods if you use the return label provided by us for a return initiated within Germany. Otherwise, the return costs are to be borne by you. You must pay for any loss in value of the goods only if this loss in value is due to handling of the goods that is not necessary for checking the condition, properties and functioning of the goods.
REASONSFOR EXCLUSION
The right of withdrawal does not apply to contracts for the supply of goods that are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is relevant or which are clearly tailored to the personal needs of the consumer. The right of withdrawal expires when the goods are put into use.

RIGHT OF RETURN
Regardless of the statutory right of withdrawal, customers residing in Germany can return all products purchased through our online store free of charge within 14 days of receipt. You can find more information about the return procedure here. The 14-day return period begins on the day on which you or a third party named by you, who is not the carrier, has taken possession of the last product. To exercise your right of return, you must return the goods to us within the 14-day period. As soon as we have received the goods, we will refund the purchase price.
The right of return does not apply to goods that are not prefabricated and for the production of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer. Likewise, the right of return no longer exists if the goods have been used and are therefore no longer in a new condition.
You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking the condition, properties and functioning of the goods.
This right of return exists in addition to the statutory right of withdrawal and does not restrict it in any way.
In the event of a revocation, we will refund you the purchase amount including shipping costs of shipment to customer.
In case of a return, we will refund you the purchase amount including shipping costs of shipment to customer, if all items from the order are returned. If at least one item of a shipment is kept, the shipping costs in the case of this partial return can not be refunded.
This applies to shipments within Germany and to all EU countries.
Third countries (all countries outside the EU) are excluded from this rule. Here, even in the case of a complete return or revocation, the outbound costs cannot be refunded.
Returncosts within Germany:
For a return due to a revocation or a justified return within Germany, we assume the costs for the return shipment.
Return shippingcosts from abroad:
For returns from all other countries (EU and third countries) the customer bears the costs for insured return shipping.

The available product images and informational text represent the product as accurately as possible. We cannot guarantee that all images accurately represent the actual appearance of the items. Images may vary depending on your computer's color settings.
DISCLAIMERS
Please check the received goods to make sure they are not damaged and were delivered correctly. If your order has been damaged in transit, please notify the relevant delivery service as soon as possible. You will help us to handle faulty deliveries or in case of transport damages. Your right of withdrawal and the legal warranty claims remain unaffected.
In order to facilitate the handling in case of damage, we ask you to send complaints to our customer service. Please indicate the order number and the reason for the complaint so that we can process it as quickly as possible. Of course you can also inform us about damages and/or faulty deliveries in another way (e.g. by letter).
LIABILITY
We shall only be liable for damages resulting from an intentional or grossly negligent breach of duty. We shall only be liable for simple negligence in the event of injury to life, limb or health or an essential contractual obligation. Essential contractual obligations are those whose fulfillment is necessary for the achievement of the objective of the contract or which make the execution of the contract possible in the first place. In the event of a slightly negligent breach of essential contractual obligations, we shall be liable up to the amount of the damage typical for the contract and foreseeable at the time of conclusion of the contract.
The above limitations of liability shall also apply in favor of our legal representatives and vicarious agents.
Liability under the Product Liability Act remains unaffected.
PROPERTY RESERVATION
All products remain the property of Bernd Hummel GmbH until full payment has been received.
FRAUD
In case of any fraud attempts reported by the police, Bernd Hummel GmbH reserves the right to cancel the order in case of suspicion.
DATA PROTECTION
We treat your personal data confidentially and according to the legal data protection regulations.

APPLICABLE LAW, JURISDICTION
Applicable law is the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods, insofar as this choice of law does not result in a consumer being deprived of mandatory consumer protection standards.
CONCLUSION
To the extent that any provision of this Agreement is or becomes invalid or unenforceable, the remaining provisions of this Agreement shall not be affected thereby.
